1. Who we are and what this policy is about
Reference to "we" or "our", as relevant is reference to Indelible House Pty Ltd A.C.N 604 709 168 trading as Indelible Shop. Indelible™ is a trademark owned by Indelible House Pty Ltd.
This Policy applies to Personal Information collected by Indelible™. when you acquire goods from Indelible™ Shop.
What is Indelible?
Indelible is a business that provides products, authentication and provenance services that includes the signing, stamping, provision of QR Code or affixing a unique mark on goods and or services with a unique identifiable and traceable solution which authenticates the origin and genuineness of goods and or services (Indelible Services).
For the purpose of this policy QR Code means a machine readable 2 dimension code that stores encoded information usually in the form of an array of black and white squares and which may connect to a website or other information.
This Policy governs the manner in which Indelible collects, stores, uses and disclose Personal Information in connection with providing Indelible Services. This policy describes our commitment in relation to protecting your privacy.
What is Personal Information?
Generally speaking, Personal Information is information (or opinion), in any form, about an individual (not a business, company or trust) whose identity is apparent or can be ascertained from the information held whether the information is true or not.
Personal information does not include information that is collected anonymously, information in the public domain or information that has been de-identified, so that it cannot identify or be reasonably linked to you.
2. General Commitment and Personal Information
Indelible understands and identifies the importance of your privacy and is committed to safeguarding your Personal Information it collects, receives and discloses and is committed to doing so in accordance with the requirements of the Privacy Act, 1988 (Cth) (Privacy Act) as amended from time to time.
3. Purchase of Goods
What information we collect?
The Personal Information we collect in a transaction is limited to your name and surname, address, mobile number and email address, details of purchased items, and history of testing requests.
If you pay with credit or with a debit card, we do not store card information. We use a third-party service provider (Airwallex) to process credit and debit card transactions.
If you do not agree or do not provide some or all of the information requested, we may not be able to process your transaction.
How do we use Personal Information?
We will use your Personal Information for 2 main purposes. Firstly, to complete the purchase transaction you desire and deliver the Indelible Services to you with respect to the goods you purchased and secondly, to communicate with you in the future about further services we may provide or any goods or services we offer which carry the Indelible authenticity stamp.
We may use your Personal Information to improve the Indelible Services, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews and to create a customised shopping experience for you.
If you requested authentication testing, we would use Personal Information we have in relation to your transaction and product purchased to enable the testing and provide that service to you.
In this regard, we may disclose your Personal Information to related companies and businesses we own and/or work with including third party service providers who conduct the authentication testing.

4. Our general commitment
We undertake to collect, store and use Personal Information only in a manner which is compliant with the Privacy Act. We will not use or disclose Personal Information other than for:
a purpose set out in this Privacy Policy,
a purpose for which the information was provided,

to give effect to your instructions.

We collect and disclose Personal Information as it may become necessary to provide the Indelible Service, process your transaction and give effect to your instructions.
We will collect Personal Information from you directly, from the use of Cookies (see paragraph 17) or from our authorised service providers and partners.
We may disclose your Personal Information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government/semi government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms and conditions of use or policies.
7. Third Party Service Provider
Subject to the Privacy Act, in the process of providing you with the Indelible Services, we may share, as relevant, Personal Information with related bodies corporate and with third parties with whom we have dealings in the usual course of carrying on our business. These third-party service providers may include agents, portfolio managers, authentication laboratories content and product producers, logistic providers, mailhouse operators, research providers, dispute resolution schemes, accounting and legal advisers.

External service providers to us, such as organisations which we use to verify your identity, payment systems operators, mailing houses, authentication (testing) laboratories and research consultants.

Indelible Services and Shopify
Indelible Shop is powered by Shopify.
Shopify is an online e-commerce platform that enables businesses like Indelible to manage and run the Indelible Shop and provide the customer with the Indelible Services.
Indelible does not retain any financial information that the customer use to complete a transaction on the Indelible Shop. Any financial information and the security of such information is managed by Shopify as an accredited online financial service provider.
Shopify has its own privacy policy which governs the manner in which Shopify collect, stores, uses and disclose your Personal Information and any relevant financial information (credit card details, account details etc). you can access the Shopify privacy policy by using this link.
There should not be a conflict between this policy and the Shopify privacy policy, however, if there is a conflict between our policy and the Shopify privacy policy, this policy will take precedent. If you have any concerns about how the 2 policies operate, please raise this with us using the link in paragraph 19.
8. Access to your personal information
You have the right to seek access to any information we hold about you. Contact our privacy officer using the link provided below. We may charge you a fee to access and or correct your Personal Information that is held with us. You have the right to ask us to correct any information we hold about you if the information is inaccurate or erroneous.
9. Security of your personal information and third party links
We maintain strict procedures and standards and take all reasonable care to prevent unauthorised access to, and modification and disclosure of, your Personal Information. We will protect any Personal Information we hold against misuse or loss. If we no longer need the Personal Information, we will take steps to either destroy the information or de-identify it.

These third party links and or platforms are not controlled by us or associated with Indelible Shop. We recommend that before clicking on any link, you should review the third party platform and any services they offered and their policies and terms.
We do not guarantee and are not responsible for the privacy or security of such sites or platforms including the accuracy, completeness, or reliability of information found on these sites.
Care should be exercised when providing information on public or semi-public venues, including information you share on third-party social networking platforms as information may be intercepted and or shared without your knowledge and consent. The inclusion of any links on our website does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.
10. Direct marketing
We may use your Personal Information to provide you with information from time to time in relation to additional services and or products we or our third party relationships provide. You expressly authorise us to provide you with this information. You may withdraw your consent at any time by calling us or unsubscribing directly from any email or sms.
11. Government identifiers
We do not have access to any Personal Information that can be regarded as or be used as an identifier unless you supply it to us. For example, we do not have access to your Medicare number or tax file number. We will not use any government identifier to identify you.

13. Changes to this Privacy Policy
We reserve the right to vary this policy from time to time. If we change the policy, we will post the revised policy as soon as it is completed on our website. We do not have to provide you with notice of changes to the policy. We encourage you to periodically review our privacy policy for any changes.
14. Transborder use of data
We will disclose Personal Information to overseas entities that we partnership with . If we disclose Personal Information to overseas entities, we will ensure that they protect the privacy of your Personal Information as we are committed under this Policy and the Privacy Act. For example, if we disclose Personal Information to any jurisdiction in the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms like the European Commission's Standard Contractual Clauses or UK equivalent for the protection of your privacy.
15. Application of this Policy to transactions initiated outside of Australia
This Policy and the application of the Australian Privacy Principles within the Australian Privacy Act 1988 apply to all transactions with Indelible House and the provision of the Indelible Services irrespective whether the customer resides outside of Australia.
Customers residing outside of Australia are encouraged to familiarise themselves with the Australian Privacy Principles within the Australian Privacy Act 1988 as they apply to their dealing with Indelible House and acquiring the Indelible Services. Depending on where the customer lives, there may be additional rights that the customer may claim to have in relation to access to Personal Information, correction of Personal Information, communication, preferences and marketing. It is acknowledged that the origin of the Indelible Services is Australia. To the extent permissible, if there is a conflict between the rights in relation to Personal Information where the customer lives and this policy, this policy will prevail to the extent of any inconsistency.

When you use our website, we may collect statistical data in relation to your use of the site. This date includes the time and date of the visit to the site, the nature of the inquiry and any documents loaded. We may record your browser type and other internet protocols as permitted.
